These Terms & Conditions ("Terms") govern your access to and use of SportsCardWorld.com (the "Site") and any purchases from Nexmark, Inc. ("Nexmark," "we," "us," or "our"). By visiting the Site or placing an order, you agree to these Terms and to our Privacy Policy and Shipping & Returns (collectively, the "Policies"). If you do not agree, please do not use the Site.

1) Eligibility & Account
You must be at least the age of majority in your jurisdiction to purchase.
If you create an account, you are responsible for maintaining its confidentiality and for all activity under it. Notify us immediately of any unauthorized use.
2) Products, Condition, and Availability
Collectibles & condition. Unless otherwise noted on a product page, trading cards and collectibles are sold as pictured and described. Condition notes may include terms commonly used in the hobby (e.g., "raw," "pack-fresh," "factory sealed," "near mint"), which are good-faith descriptions but not professional grading. Raw cards are not guaranteed to achieve any specific third-party grade.
Images. Photos are representative and, for multi-quantity listings, may show a sample rather than the exact serial number or minor variation you receive; any material differences will be disclosed.
Availability & limits. We may limit quantities, refuse, or cancel orders where inventory is unavailable or where we suspect fraud or policy abuse.
3) Pricing, Taxes & Promotions
Prices are shown in U.S. dollars unless stated otherwise and may change without notice until an order is submitted.
Taxes and applicable fees (e.g., sales or import taxes) are calculated at checkout based on ship-to address and applicable law.
Promotions/coupons are subject to stated terms, dates, and exclusions. Promotional pricing applies only during the promotion period and while supplies last. We may cancel any order that relies on an invalid or manipulated promotion.
4) Orders & Acceptance
Your order is an offer to buy. We accept only when we dispatch your order (or otherwise confirm acceptance). Order confirmation emails acknowledge receipt but do not constitute acceptance.
If an item is out of stock, we'll notify you, cancel that item, and refund any charges for it.
5) Payment
We accept the payment methods shown at checkout (e.g., major credit/debit card and PayPal). By submitting payment, you represent you are authorized to use the method and authorize us (and our payment processors) to charge the full order total, including taxes and shipping.
We use third-party processors; we do not store full card details on our servers.
6) Shipping, Delivery & Risk of Loss
Processing time. Typical handling time is 1–2 business days (Mon–Fri, excluding holidays). Handling times may extend during high-volume periods; any extended delays will be disclosed on the Site or by email.
Methods & estimates. We ship via USPS or UPS. Estimated delivery windows (e.g., 3–7 business days within the continental U.S.) are estimates only and not guarantees.
Tracking. A tracking number will be provided when available.
Risk of loss/title passes to you upon delivery to the carrier. Please file carrier claims for loss or damage in transit; we'll assist when possible.
Shipping restrictions. We currently ship within the United States. Some items may have destination restrictions due to licensing or local laws.
7) Returns, Refunds & Cancellations
Return window. We accept returns requested within 30 days of delivery for items in the same condition received (unopened products must remain sealed).
How to start a return. Contact us at [email protected] with your order number within the return window to obtain an RMA and instructions. Unauthorized returns may be refused.
Refund method & timing. Approved refunds are issued to the original payment method within 3 business days after we receive and inspect the return. Shipping fees are non-refundable unless the error was ours.
Return shipping costs. Customer pays return postage unless item is incorrect, damaged, or not as described.
Non-returnable items. Opened sealed products, digital downloads, and items specifically marked final sale are not returnable unless required by law.
Order changes/cancellations. We'll try to accommodate requests before shipment, but we cannot guarantee changes once an order is processing.
8) Product Authenticity & Anti-Counterfeit
We source products from reputable distributors and the secondary market. We do not knowingly sell counterfeit items. If you believe an item is not authentic, contact [email protected] within 7 days of delivery with evidence; we'll review and, if confirmed, provide a remedy consistent with our Policies and applicable law.
9) Errors, Accuracy & Limited Liability
We strive for accuracy but errors (pricing, availability, descriptions, images) may occur. We may cancel any order affected by an obvious or material error and refund your payment.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXMARK, INC. AND ITS AFFILIATES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; AND OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SITE OR ANY ORDER SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE ITEM(S) AT ISSUE.
Some jurisdictions do not allow certain limits; in that case, the limits apply to the fullest extent permitted.
10) User Content (Reviews, Submissions)
If you post reviews or submit content, you grant us a worldwide, royalty-free license to use, reproduce, and display that content in connection with the Site and our business. You represent you own or have rights to the content and that it does not violate any law or third-party rights. We may remove content that violates these Terms.
11) Acceptable Use
You agree not to: (a) misuse the Site; (b) attempt to probe or breach security; (c) use bots/scrapers to harvest data without permission; (d) engage in fraud, resale abuse, or coupon manipulation; or (e) violate applicable laws.
12) Intellectual Property
All Site content (logos, text, graphics, product listings, and images) is owned by Nexmark, Inc. or its licensors and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without prior written consent.
13) Third-Party Services
The Site may link to or integrate third-party services (e.g., payment processors, carriers). Those services are governed by their own terms and privacy practices. We are not responsible for third-party sites or services.
14) Privacy
Your use of the Site is subject to our Privacy Policy, which explains how we collect, use, and share personal information, including with payment processors, carriers, fraud-prevention services, and analytics providers.
15) Disputes; Governing Law
Governing law & venue. These Terms are governed by the laws of Florida, USA, without regard to conflict-of-law rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Miami-Dade County, Florida for disputes not subject to arbitration.
Informal resolution first. Before filing a claim, you agree to email [email protected] with a description of the dispute and allow 30 days to resolve it informally.
16) Changes to the Terms
We may update these Terms from time to time. The "Effective date" above reflects the latest revision. Material changes will apply prospectively. Continued use of the Site after a change means you accept the updated Terms.
